Welcome to Declara. These terms set out the basis on which you may use it. By accessing or using Declara, you agree to these terms. If you don't agree with them, please don't use the tool.

1. Who We Are

Declara is an independent project (referred to in these terms as "Declara," "we," or "us"). You can contact us at support@declara.co.uk.

2. What Declara Is — and Isn't

Declara is a decision-support tool. It screens commodity codes and destinations against the live UK Trade Tariff, flags the controls, waivers, and licences that may apply, and (in duty mode) estimates the EU low-value parcel duty.

Declara surfaces information and options — a person always makes the final decision. It does not make customs filings, and it does not decide anything for you. Its screening covers commodity code and destination only: it does not assess end-use, end-user, or denied-party/sanctions matters, and duty figures are estimates only.

3. Not Professional Advice

Declara is informational and does not constitute legal, customs, tax, or other professional advice. Results are generated from live HMRC data but are not guaranteed to be accurate, complete, or current. You are solely responsible for verifying any result and for your own classification, compliance, and filing decisions. Always confirm against the official UK Trade Tariff and, where appropriate, a qualified professional before relying on a result.

4. No Warranty

Declara is provided "as is" and "as available," without warranties of any kind — including accuracy, availability, fitness for a particular purpose, or uninterrupted or error-free operation.

5. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any loss or damage arising from your use of, or reliance on, Declara — including (without limitation) rejected declarations, penalties, delays, or any indirect or consequential loss such as lost profits or goodwill. You use Declara at your own risk. Nothing in these terms excludes liability that cannot be excluded by law (for example, for death or personal injury caused by negligence, or for fraud).

6. Acceptable Use

You agree to use Declara lawfully and not to: misuse, overload, or attempt to circumvent its rate limits or security; scrape, copy, reverse-engineer, or resell it; or rely on it as your sole compliance control. We may suspend or withdraw access for misuse.

7. Intellectual Property

The Declara name, tool, and its content are ours. UK Trade Tariff data is public sector information used under the Open Government Licence v3.0 (attributed within the tool).

8. Availability and Changes to the Service

We may change, suspend, or withdraw Declara (in whole or in part) at any time, without notice or liability, and we do not guarantee any particular level of availability or support.

9. Your Account

Access requires signing in through our authentication provider (Clerk). You are responsible for keeping your sign-in secure and for activity under your account. We may decline or revoke access at our discretion.

How we handle personal data is set out in our Privacy Notice.

11. Changes to These Terms

We may update these terms from time to time; the "Last Updated" date above shows when. Continuing to use Declara after a change means you accept the updated terms.

12. Governing Law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
